Terms of Service

1. Introduction

These Terms of Service ("Terms") are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the SarvannaOS website, platform, and any related mobile or software applications (collectively, the "Services"). SarvannaOS is a product of Techseed Ai Solution Pvt. Ltd. ("We", "Us", or "Our").

By downloading, accessing, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you should stop using the Services immediately.

2. Definitions

• "Services" includes business applications like Point of Sale (POS), Kitchen Display Systems (KDS), Table Management, and Menu Management provided by SarvannaOS.
• "Content" means the content that we create and make available, including visual interfaces, graphics, design, computer code, and reports.
• "User Content" means content that you upload, share, or transmit through the Services, such as restaurant menus, table configurations, customer information, and images.
• "You" shall mean the restaurant, merchant, or individual user accessing the Services.

3. General Rules Relating to Conduct

We grant you a personal, limited, non-exclusive, and non-transferable license to access and use the Services. You agree that when using the Services, you will comply with all applicable laws and these Terms. In particular, you agree not to:

• Use the Services for any unlawful manner or in a manner that promotes illegal activity.
• Attempt to gain unauthorized access to the Services, other user accounts, or any networks connected to the Services.
• Modify, adapt, translate, reverse engineer, or decompile any part of the software.
• Upload malicious code, viruses, spyware, or Trojan horses.

4. Subscriptions, Billing, and Refund Policy

Free Trial: You may start using our Services with a free trial as specified during sign-up. The trial allows you to evaluate the platform before being billed.

Billing: Subscription fees are billed on a monthly or annual basis depending on your selected plan. We will bill your chosen Payment Method at the end of the free trial period (if applicable) unless you cancel beforehand. Prices are subject to change with prior notice.

Cancellation & Refund Policy: We offer a 100% refund if you choose to cancel your plan within 15 days of your initial application/purchase. After this 15-day period has passed, there is a strict no-refund and no-return policy for any partial or fully unused membership periods. For ongoing monthly subscriptions: You may cancel your plan at any time; however, the cancellation will take effect starting from the upcoming billing month, and no refund will be issued for the current month.

5. Intellectual Property Rights

We are the sole and exclusive copyright owners of the Services and our Content. We exclusively own the copyrights, trademarks, service marks, logos, trade names, and other proprietary rights associated with the Services.

By submitting User Content, you grant us a perpetual, non-exclusive, royalty-free right to use, adapt, and publish your content solely for the purpose of operating, improving, and providing the Services to you. You remain solely responsible for your User Content and must ensure it does not infringe on any third party rights.

6. Service Suspension and Data Retention

We reserve the right to suspend or cease providing services with or without notice if you violate these Terms.

If your subscription expires and is not renewed, your account may be marked as "dormant." During this time, access to the POS and backend will be restricted. If the account remains dormant beyond the specified grace period, we reserve the right to suspend the account and permanently clean up data, menus, and logs associated with the account. Upon termination, you are responsible for exporting your data within the provided timeframe.

7. Disclaimer of Warranties

Use of the app is at your own risk. The app is provided on an "As Is" basis.

To the maximum extent permitted by law, Techseed Ai Solution Pvt. Ltd. disclaims all liability whatsoever in relation to the Services. All implied warranties, terms, and conditions relating to accuracy, completeness, performance, fitness for a particular purpose, and non-infringement are hereby excluded. We accept no responsibility for technical failures of the internet or damage to your equipment resulting from the use of our Services.

8. Limitation of Liability

In no event shall Techseed Ai Solution Pvt. Ltd., its officers, directors, or employees, be held liable for any indirect, consequential, special, or punitive damages arising out of or in any way connected with your use of the Services, including but not limited to loss of revenues, profits, data, or goodwill. Our maximum liability to you under all circumstances will be limited to the sums paid by you upon purchasing the subscription during the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Techseed Ai Solution Pvt. Ltd. in full and on demand from and against any and all liabilities, costs, demands, causes of action, damages, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your use of the Services, or your violation of any third-party rights.

10. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India. Any legal action, dispute, or proceeding arising out of or relating to your access to or use of the Services shall be instituted exclusively in the competent courts of India, and you agree to submit to their jurisdiction.

11. Changes and Contact

We reserve the right to update these Terms from time to time. The updated version will be effective immediately upon posting. Your continued use of the Services signifies your acceptance of the new Terms.
